This is Terms of Use Agreement (“Agreement”) between you and RoadWarriorVPN.com for virtual private network communications services, related services and features (“the Service”).

1. Acceptance of Terms

You agree to the terms and conditions outlined in this Agreement with respect to RoadWarriorVPN.com. This Agreement constitutes the entire and only agreement between RoadWarriorVPN.com and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to RoadWarriorVPN.com, the content, products or services provided by or through RoadWarriorVPN.com, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on RoadWarriorVPN.com, and you should review this Agreement prior to using the RoadWarriorVPN.com.

2. Member Account, Password, and Security

You will receive a password and account designation upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify RoadWarriorVPN.com of any unauthorized use of your password or account or any other breach of security. RoadWarriorVPN.com cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2.

3. Usage Policies

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not RoadWarriorVPN.com, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. RoadWarriorVPN.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will RoadWarriorVPN.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Service.

Loggkeeping

We do not monitor, record or store logs for any single customers VPN activity. We will however record the following data:

2. Duration of the vpn connection

3. Bandwidth used during the connection

This information is regularly cycled within our servers. This information enables us to enforce our Terms of Service, spam, crimes using the service, etc. If there is a violation we will use these trace logs to determine which account is in violation. After lengthy analysis of this data, we will terminate the service and/or take further action.

Sharing of Account Details

Each VPN account issued is to be used by one person and not to be set up and used similtaneously on multiple computers! We will warn a user when an account is in violation. Should a user continue to violate this rule, we would terminate account without further notice and NO refund will be issued to the buyer. You many only connect to one VPN serv at a time. If you are found connecting to mulitipule VPN servers your session will be terminated from one or all of the VPN servers. If you continue to violate this policy your account may be terminated without further notice and NO refund will be issued to the buyer.

You agree not to use the Service to:

a. upload, post, email. transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

b. harm minors in any way;

c. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

d. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements

e. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (“Rights”) of any party;

f. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

g. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; and

h. update, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or any other form of solicitation.

Violations of this Usage Policy will result in termination of your account, without any refund of amounts previously paid for this Service.

4. Service Availability

Actual Service coverage, speeds, locations and quality may vary. Service is subject to unavailability, including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair, and may be interrupted, refused, limited or curtailed. We are not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks (e.g., T-1 lines or the Internet). We may impose credit, usage or Service limits, suspend Service, or block certain kinds of usage in our sole discretion to protect users, our network or our business. Network speed is an estimate and is no indication of the speed at which your Device or the Service sends or receives data. Actual network speed will vary based on Device configuration, compression, distance, network congestion, interference and other factors. The accuracy and timeliness of data received is not guaranteed; delays or omissions may occur.

5. Content Disclaimer: Cautions and Restrictions

We do not control, nor are we responsible or liable for, data, content, services, or products (including software) that you access, download, receive or buy via the Service. The Internet may provide access to content you consider harmful to minors, or otherwise offensive or inappropriate. If you wish to limit access to such content, there are a number of commercially available products that can help you do so. We may, but do not have to, block information, transmissions or access to certain information, services, products or domains to protect us, our network, the public or our users. Therefore, messages and other content may be deleted before delivery. The Internet contains unedited materials, some of which may be offensive to you. We are not a publisher of third party content accessed through the Service and are not responsible for the content, accuracy, timeliness or delivery of any opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Service. You are responsible for paying all fees and charges of third party vendors whose sites, products or services you access, buy or use via the Service. If you choose to use the Service to access web sites, services or content, or purchase products from third parties, your personal information may be available to the third-party provider. How third parties handle and use your personal information related to their sites and services is governed by their security, privacy and other policies (if any) and not ours. 6. Cancellation Policy

You may have a full refund if you are unhappy with service for any reason if cancelation is requested through self service within 24 hours of singing up. The Service reserves the right to change this policy at any time.

7. Termination

You agree that RoadWarriorVPN.com may, under certain circumstances and without prior notice, immediately terminate your account and access to the Service. Cause for such termination shall include, but not be limited to: (a) breaches or violations of the Agreement or other incorporated agreements or guidelines; (b) requests by law enforcement or other government agencies; (c) a request by you (self-initiated account deletions); (d) discontinuance or material modification to the Service (or any part thereof); (e) unexpected technical or security issues or problems; (f) extended periods of inactivity; (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your account includes, but is not limited to: (a) removal of access to all offerings within the service; (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof); and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in the sole discretion of RoadWarriorVPN.com and that RoadWarriorVPN.com shall not be liable to you or any third party for any termination of your account or access to the Service.

8. Digital Millennium Copyright Act Notice

In operating the Service, we may act as a "services provider" (as defined in the DMCA) and offer services as an online provider of materials and links to third party web sites. As a result, third party materials that are not owned or controlled by us may be transmitted, stored, accessed or otherwise made available using the Service. If you believe any material available via the Service infringes a copyright, you should notify us using the notice procedure for claimed infringement under the DMCA. We will respond expeditiously to remove or disable access to material we determine may be infringing and will follow the procedures specified in the DMCA to resolve the claim between the notifying party and the party who has allegedly infringed.

ROADWARRIORVPN.COM AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

b. ROADWARRIORVPN.COM AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ROADWARRIORVPN.COM OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE AGREEMENT.

10. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ROADWARRIORVPN.COM AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ROADWARRIORVPN.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SER VICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

11. Indemnity

You agree to indemnify and hold RoadWarriorVPN.com and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms or Service, or your violation of any rights of another.

12. Jurisdiction

You agree that exclusive jurisdiction for any dispute with RoadWarriorVPN.com, or any problems relating to your use of the site, resides in the Commonwealth of Massachusetts. You also agree and consent to the exercise of personal jurisdiction in the Commonwealth of Massachusetts in connection with any dispute involving any RoadWarriorVPN.com or its licensors, employees, officers, directors, and telecommunications providers.

13. Entire Agreement

This Agreement between the parties constitutes the full and entire understanding between the parties with regard to the subjects hereof and thereof and supersedes any and all previous agreements between the parties regarding the subjects hereof and thereof. This agreement may be modified by the mutual consent of both parties, provided however, that any such modification shall be in writing, dated, and signed by both parties.

14. Account Holder Certification

The Account Holder certifies that he/she is eighteen (18) years of age or a bona-fide corporate representative, and that the registration information provided is accurate, complete, and up to date.


The abuse and misuse of e-mail is a serious problem, and Road Warrior VPN.com will not tolerate it. Since it is unsolicited, users who receive SPAM often become angry and send complaints to our upstream providers. This upsets our providers who abhor SPAM for the same reasons that Road Warrior VPN.com does - it causes negative consumer attitudes and drains resources. We strive to maintain favorable business relationships in the Web community and obviously will not allow any practice that threatens these relationships.

SPAM is not only harmful because of its negative impact on consumer attitudes toward Road Warrior VPN.com, but also because it can overload Road Warrior VPN.com's network and resources, especially on our shared (virtual) server environments.

Definition of UCE (Unsolicited Commercial E-mail), or SPAM

The bulk UCE, promotional material, or other forms of solicitation sent via e-mail that advertise any IP address belonging to Road Warrior VPN.com or any URL (domain) that is hosted by Road Warrior VPN.com.

Unsolicited postings to newsgroups advertising any IP or URL hosted by Road Warrior VPN.com.

The use of web pages set up on ISPs that allow SPAM-ing (also known as "ghost sites") that directly or indirectly reference customers to domains or IP addresses hosted by Road Warrior VPN.com.

Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate a means to SPAM.

Forging or misrepresenting message headers, whether in whole or in part, to mask the true origin of the message.

Punishment For SPAM

Road Warrior VPN.com reserves the right to terminate, without warning, any account that violates this policy. Usage of Road Warrior VPN.com services constitutes acceptance and understanding of this policy.

Road Warrior VPN.com may, at its option, charge $25.00 per SPAM complaint we receive for both Dedicated and Virtual Server customers. Resellers will be charged for resold accounts, receiving SPAM complaints. Reseller may choose to pass this charge down to their client. These are non-refundable charges and will be invoiced at the time of complaint notification.

Road Warrior VPN.com reserves the right to decide what it considers "SPAM", "UCE", "mail bombing", or "bulk e-mail",and to determine from all of the evidence whether or not the e-mail recipients were from an "opt-in" e-mail list.

SPAM Guidelines

Should you choose to e-mail from Road Warrior VPN.com servers, especially if you use mailing lists, you must read and adhere to the following guidelines, which are offered as a statement of Internet standards and best current practices for proper mailing list management and preventing e-mail abuse.

Basic Mailing List Management Principles for Preventing Abuse

Mailing lists are an excellent vehicle for distributing focused, targeted information to an interested, receptive audience. Consequently, mailing lists have been used successfully as a highly effective direct marketing tool. We highly recommend the use of Double Opt in methods to obtain emails from interested clients.

Unfortunately, some marketers misuse mailing lists through a lack of understanding of Internet customs and rules of the forum pertaining to e-mail. Information about users that is maintained on our systems is protected using industry standard security measures. However, we cannot guarantee that the information submitted to, maintained on, or transmitted from our systems will be completely secure.

5. Corrections

If your name, e-mail or postal address, telephone number or other Personal Information changes, you may update, correct or omit the relevant information by logging into self service.

6. Logging Policy

We do not spy on our users and we don't monitor their Internet usage. If we have reasonable grounds to suspect that an end user is involved in criminal activities, we reserve the right to notify law enforcement agencies. We my disclose your Personal Information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Road Warrior VPN.com or parent company; (b) protect and defend the rights or property of Road Warrior VPN.com, the site or the users of Road Warrior VPN.com ; and, (c) act to protect the personal safety of users of Road Warrior VPN.com, the site or the public.

credit card acceptance again with 3D Secure

Road Warrior VPN.com has always accepted credit cards.  The catch is that there have been times that we had to disable credit cards for new sign up’s because of the amount of unwanted fraud that we received at times.  We are happy to announce that because of a combination of work that has been going on lately we are able to re open new orders to accepting credit cards.  Upgrading to the new billing software and the addition of a new credit card procession company we are now using has made it possible to accept credit cards on new orders again.  We are now able to screen new orders with 3D Secure, which is implemented by many credit card companies to ask the card holder for their personal password.  This will provider a greater security for everyone.

Where do you want Road Warrior VPN.com to add new VPN servers? So currenlty they are only location in the East Coast of USA. Do you still just want a second location in the USA or would you rather have VPN servers location in a diffrent country in the great wide world. Make your voice heard and let us know your opinion.
